Terms of Service

These terms are a legal agreement between you and GovAccess. By creating an account or running a scan, you agree to them. If you don't, please do not use the service.

1. The service

GovAccess provides automated WCAG 2.1 AA accessibility scans of public-facing websites and generates compliance reports intended to support, but not replace, a good-faith ADA Title II compliance program.

The free scan analyzes a single page. Paid plans (currently "Pro" at $149/month) unlock full-site scanning, downloadable PDF reports, and the limits described on our pricing page.

2. Account & eligibility

You must be at least 16 years old and authorized to act on behalf of any organization you list in your account. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account.

3. Acceptable use

You agree NOT to:

  • Submit URLs you do not own or have written authorization to scan. The free scan and the "Add Site" flow are intended for websites you control.
  • Attempt to scan internal hosts, private IP ranges, cloud metadata endpoints, or any system you do not own. Such requests are blocked at multiple layers and may result in immediate suspension.
  • Reverse-engineer, scrape, automate signups, or attempt to exceed plan quotas through any technical means.
  • Use the service to facilitate unauthorized access to any third-party system, distribute malware, or violate any law.
  • Resell access to the service without a written agreement with us.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

4. Free trial & billing

The Pro plan includes a 14-day free trial. You may cancel at any time during the trial via the Stripe billing portal accessible from your dashboard. If you do not cancel, your card will be charged $149 at the end of the trial and monthly thereafter.

Subscriptions are billed monthly in advance. Prices are listed on the pricing page and are subject to change with at least 30 days notice for existing subscribers.

Failed payments: if a charge fails, your subscription will be marked "past due". We will retry the charge a few times over roughly 3 weeks (Stripe Smart Retries). If all retries fail, your access will be downgraded to the free plan.

Refunds: we do not offer prorated refunds for partial months. If you experience a service-impacting issue, email hello@govaccess.us and we will review on a case-by-case basis.

Cancellation: you may cancel at any time. You keep access through the end of your paid period; the subscription is not renewed afterward.

5. The reports we produce

GovAccess uses the open-source axe-core engine to detect accessibility violations. Automated tools detect approximately 57% of WCAG conformance issues (Deque Systems research, 2023); the remaining issues require manual testing with assistive technology and human judgment.

Our reports do not constitute legal advice and do not certify ADA Title II conformance. They are designed to identify automatically detectable issues and document a good-faith effort toward compliance. You are responsible for reviewing the results, prioritizing remediation, and obtaining independent legal or accessibility counsel as appropriate.

Compliance scores are derived from a severity-weighted formula we describe in the report's methodology section. They are indicators of progress, not pass/fail certifications.

6. Your data

Our handling of personal information is described in our Privacy Policy. You retain ownership of the URLs you submit and the resulting scan data. You grant us a limited license to process them as needed to provide the service.

You may export or delete your data at any time. Deletion is permanent.

7. Service availability & changes

We aim for high availability but do not guarantee any specific uptime SLA. The service may be temporarily unavailable due to maintenance, dependency outages (Vercel, Supabase, Railway, Stripe, Upstash), or unforeseen incidents.

We may add, change, or remove features at any time. If a change materially reduces functionality you rely on, we will notify active subscribers by email at least 14 days in advance and offer a prorated refund if you choose to cancel.

8. Intellectual property

The GovAccess platform, including the software, fix-suggestion library, report templates, branding, and content (excluding your data and third-party open-source components), is owned by GovAccess. You receive a non-exclusive, non-transferable license to use the service during your subscription.

Your scan data and PDF reports are yours to use, share, and attach to compliance documentation.

9. Disclaimer of warranties

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or any warranty arising from course of dealing or usage of trade.

We do not warrant that the scans will detect all accessibility issues, that results will be free of false positives or false negatives, or that the use of our reports will prevent legal claims.

10. Limitation of liability

To the maximum extent permitted by law, GovAccess's total cumulative liability arising out of or related to the service shall not exceed the greater of (a) one hundred US dollars ($100) or (b) the total fees you paid us in the twelve months preceding the event giving rise to the claim.

In no event shall GovAccess be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in those jurisdictions, the above limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold GovAccess harmless from any claim, damage, or expense arising from (a) your violation of these Terms, (b) URLs you submitted that you were not authorized to scan, or (c) misuse of the service that breaches applicable law.

12. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

You may bring small-claims actions in your county of residence if eligible.

13. Changes to these terms

We may update these Terms occasionally. The "Last updated" date at the top of this page reflects the current version. Material changes will be announced to active subscribers by email at least 14 days before they take effect; continuing to use the service after that date constitutes acceptance.
